Report filed on Fry probation by C.F. David Probation Officer Odie Nunley, has filed a probation report on convicted felon Dwayne Fry. The report was requested by District Judge Greg Zigler. Zigler asked that Nunley file the report because Fry is asking for a modification of his probation from a 1999 charge of “To endeavor to conspire and solicit the distribution of a controlled dangerous substance, (methamphetamine).” During a hearing in early May, Nunley, admitted to Zigler that Fry, (formerly a resident of Northeastern New Mexico) had been in Boise City more often than allowed by his probation, but added that as a convicted felon, Fry should receive the same treatment as any other individual on probation and be allowed to have his probation modified. In the report filed on June 3, Nunley wrote that Fry had been on supervised probation for four years and eight months and had reported as instructed. Nunley reported that Fry had called him and advised him when he traveled out of the district. Nunley wrote that a check with the FBI, OSBI and the ODPS, indicated Fry, who was originally sentenced on Sept. 25, 2000, had not been arrested within the last 24 months. However, on Nov. 21, 2000, Fry was issued a ticket for a motor vehicle accident due to faulty tires, and driver negligence; the case is still pending. On June 24, 2002, the District Attorney's office filed an application to revoke Fry's probation for failure to pay to the Drug Task Force. According to records filed by Nunley on June 3, this year, Fry is now current with all of his probation fees, the Cimarron County Clerk and the Drug Task Force, and has been drug tested several times and has never tested positive. Part of Fry's present probation document stipulates that he not be allowed to visit Boise City more than two or three times per week, and to stay at least 2,000 yards from former District Judge George Leach II, George Leach III, (who lives in Guymon), former Cimarron County Sheriff Ken Miller and his [Fry's] son Dallas, who lives in rural Cimarron County. Nunley reports that none of these individuals report a confrontation or threat(s) by Fry. In the report summary, Nunley writes that Fry presently lives at a residence in Southeast Boise City.
